Mercer ATV accident results in DWI arrest

An all-terrain vehicle accident early today in Mercer injured two occupants, one of whom was arrested by the highway patrol.

It happened about 12:20 Monday morning on Brant Street in Mercer.

The state patrol said 26-year-old Timothy Bomgardner, with a Springfield address, received serious injuries. A passenger, 27-year-old Benjamin Stark of Mercer, received minor injuries. Both men were taken by private vehicle to the Harrison County Community Hospital in Bethany.

The patrol investigator said the all-terrain vehicle was northbound at high speed when it entered a curve and the driver lost control. The ATV overturned, ejecting both persons. The report noted the machine came to rest on top of Bomgardner.

Damage was moderate for the ATV.

Later in the day, the highway patrol arrest report indicates Timothy Bomgardner was accused of a misdemeanor driving while intoxicated and a felony of second-degree assault.
