ROCKVILLE, Md. (WJLA/CNN) — Police said two Maryland high school students — one of whom was in the country illegally — were arrested and charged with raping a 14-year-old girl in a bathroom during school hours.
Montgomery County Police said the girl was walking in a hallway at Rockville High School on Thursday when the two teens approached her.
According to charging documents, 17-year-old Jose Montano asked the girl to walk with them to have sex, but she refused. Police said he asked her again, then pushed her into a boy’s bathroom stall, where he and 18-year-old Henry Sanchez took turns raping her.
After the alleged attack, police said Sanchez placed his coat over the girl’s head while walking her out of the bathroom as Montano told her to be quiet.
The victim knew just one of her alleged attackers, according to court records.
Investigators later found blood and other DNA in the bathroom stall where the girl stated the attack occurred. It’s unclear how no one saw or heard the unconscionable rape during normal school hours.
The Special Victims Investigations Division arrested Montano and Sanchez after school officials reported the incident.
Montgomery County Court officials confirmed Sanchez entered the United States seven months ago from his native Guatemala. Those same officials stated Sanchez already had an active “alien removal case” pending in the federal judicial system.
U.S. Immigration and Customs Enforcement told WJLA-TV that it has placed a detainer on Sanchez, which is commonly done when someone is arrested and suspected of being in the country illegally. ICE would not comment on Montano because he is a minor.
Court officials said Montano came to the United States eight months ago from El Salvador. His immigration status was not immediately known.
Police said they’ve charged Montano and Sanchez with first-degree rape and two counts of first-degree sexual offense.
Montano’s mugshot was not released due to his age. However, he is being charged as an adult.
Both teenagers faces up to three life prison terms. Court records do not list attorneys for either. Both are being held without bail.
