Court Of Appeals To Meet In Gallatin

The Western District of the Missouri Court of Appeals normally meets in Kansas City, but also has occasional sessions elsewhere in the 45 county district.

A 3 judge panel is to meet at Gallatin April 30th to hear oral arguments in 3 cases appealed from Circuit Courts. The judges will hear attorneys argue whether the trials had errors that should cause them to be re-tried, or the trial court's judgment reversed. The judges will read written arguments before the court session, and may interrupt the attorney's arguments with questions.

The judges---Joseph Ellis, Karen Mitchell, and Gary Whitt-----will take a break between arguments, and remain after the court session to discuss the court system and generally
explain the proceedings.

1 case involves a conviction on charges of 2nd degree assault and 2 counts of armed criminal action following a jury trial. The charges were in connection with shootings at the Independence Center Shopping Mall in January of 2012 in which 2 persons were wounded. The defendant was sentenced to a total of 25 years in custody.

A separate case involves medical bills. The other case involved property and a life estate.

The Western District of the Missouri Court of Appeals is to meet April 30th at 9:30 in the Circuit Courtroom of the Daviess County Courthouse in Gallatin.
