News : Wrongful Death Lawsuit Moved From Grundy County Circuit Court

A wrongful death lawsuit, filed in Grundy County Circuit Court, more than three years ago, has been transferred to another northwest Missouri county for an anticipated two weeks long, trial.

The suit was filed in March of 2011 by Nancy Wilson against the Union Pacific Railroad and others following a car and train fatality accident on 1st street in the south part of Trenton. She is alleging the accident caused the wrongful death of her son, Adam Romesburg.
 
The case was moved on a change of venue to DeKalb County Circuit Court before 43rd judicial circuit court judge Thomas Chapman. Court records show trial is scheduled to begin September 22nd. Each Monday through Friday has been reserved through October 3rd for the trial at the courthouse in Maysville.
 
Two employees of the railroad and operators of the train that day, Gerald Shrum and Ed Taft, have been dismissed as defendants in the lawsuit.
 
The accident occurred December 9th of 2009, claiming the lives of three Trenton residents: 30 year old Adam Romesburg, 24 year old Nikki Groves and 28 year old Nina Spencer. Ms. Groves was identified as the driver of the car. She is still listed as a defendant ad litem for being deceased.
