News : Heavy Case Load In Grundy County Circuit Court

Division I of Grundy County Circuit Court saw a heavy case load during their last session.

21 year old Kay Smith of Trenton was sentenced to 3 years in prison after she admitted violating her probation. The probation was revoked by Judge Jack Peace. Ms. Smith had been on probation on a forgery charge.

28 year old Richard Lee of Trenton withdrew a prior plea and pleaded guilty to stealing by deceit last year. Imposition of a sentence was suspended and Lee was put on 5 years probation. He's required to pay $1,275 restitution, a $75 restitution fee, and $300 to the law enforcement fund. Monthly payments of $100 are required.

In a separate case, Lee pleaded guilty to misdemeanor receiving stolen property between last December 18th and January 4th. Imposition of sentence was suspended and Lee was put on probation for 2 years. He's also required to make restitution.

35 year old Carrie McClain of Trenton was sentenced to 7 years in prison on a charge accusing her with felony tampering with physical evidence by destroying drug paraphernalia. Execution of the sentence was stayed and Ms. McClain was put on 5 years probation. She was sentenced to 2 days in the Grundy County Detention Center on a charge accusing her with misdemeanor possession of drug paraphernalia with intent to use it to introduce a controlled substance into the human body. Ms. McClain was given credit for already serving that time in custody. The charges noted Ms. McClain has had prior convictions for distribution of a controlled substance and possessing a controlled substance---both in Grundy County.

21 year old Charles Heffner of Coffey pleaded guilty by video conference to receiving stolen property. Heffner was sentenced to 4 years in prison. Execution of a sentence was suspended and Heffner was put on 5 years probation. He's required to pay $325 restitution, a $75 restitution fee, and $300 to the law enforcement fund. Heffner has been held at the Western Reception Diagnostic and Correctional Center at St. Joseph.

35 year old Ronald Gibson of Spickard pleaded guilty to an amended charge of 2nd degree property damage. Gibson was sentenced to 60 days in the Grundy County Detention Center. Execution of the sentence was suspended and Gibson was put on 1 year's probation. He's required to pay restitution and complete anger management
counseling. Gibson was accused of damaging a glass door owned by Robert Eads and/or Hollie Harville last November. The charge previously was 2nd degree burglary.

29 year old Zachary Wilson of Humphreys pleaded guilty to an amended charge accusing him with misdemeanor non support of a child. Imposition of a sentence was suspended and Judge Peace put Wilson on 2 years probation. The charge was reduced from a felony to a misdemeanor.

60 year old David Briegel of Spickard is to have a 1 day jury trial February 3rd on a stealing charge. Briegel is accused of appropriating wedding set rings valued over $500. The owner was listed as This and That.

41 year old Lester Chase, with addresses at Chillicothe and Trenton, is scheduled to have a 1 day bench trial January 6th on charges accusing him with making a false report to Trenton Police and passing bad checks. Chase is accused of telling police numerous checks were stolen and were being forged by another person last March.

50 year old Imogene Kindle of Harris admitted violating her probation. The probation was continued with the additional condition that she's to make payments toward costs and restitution. She's on probation on charges accusing her with passing bad checks.

45 year old Lora Hynson of Trenton admitted violating her probation. The probation was continued with the added condition that she receive outpatient treatment. She's been on probation on charges accusing her with driving while intoxicated and driving while her license was suspended or revoked---with prior convictions.

41 year old Kenneth Pate of Galt requested a change of judge regarding a case in which Pate is accused of unlawful use of a firearm. The Missouri Supreme Court is to assign a
different judge. Pate is accused of being a convicted felon in Missouri who possessed a shotgun and a handgun in April.
