News : City Of Trenton Files Motion To Dismiss WCA Lawsuit

The City of Trenton has filed a motion in Division One of Grundy County Circuit Court seeking a dismissal of a Waste Corporation of Missouri suit against the city.

The Waste Corporation suit involves the Trenton City Council vote November 25th to award a residential trash collection and disposal contract to Rapid Removal Disposal for the next 5 years.

The motion seeking a dismissal of the Waste Corporation suit was filed by Trenton City Attorney, Tara Walker. The motion claims the Waste Corporation petition fails to state a claim upon which relief can be granted.

The City of Trenton is asking that the suit be dismissed with prejudice---meaning it could not be refiled. The City also is asking that its costs and expenses be paid for, and other relief the court deems proper.

A hearing is scheduled Thursday morning at 9 o'clock in Division One of Circuit Court regarding Waste Corporation of Missouri's motion for a temporary restraining order and/or preliminary injunction against the City of Trenton. Waste Corporation is seeking that action to prevent the City of Trenton from awarding the 2014 to 2018 residential sanitation collection and disposal contract to Rapid Removal. The new contract year begins January 1st.
